Paragraph 21
Notice of hearingA tribunal or court, as the case may be, shall publish the notice of hearing by causing a copy of the notice to be displayed in the place which was appointed for the delivery of nomination papers prior to the election or in some conspicuous place or places within the constituency, but failure to do so or any miscarriage of the copy of notice of hearing shall not affect the proceedings if it does not occasion injustice against any of the parties to the election petition.
This requires that notice of hearing of petitions be published or displayed in public i.e., in a conspicuous place or within the constituency. Failure to this is not a fundamental defect.
