Section 108
Dissolution of Area Council(1) An Area Council shall stand dissolved at the expiration of a period of four years commencing from the date when the—
(a) Chairman took the oath of office; or
(b) legislative arm of the Council was inaugurated, whichever is earlier.
(2) In the determination of the four years term, where a re-run election has taken place and the person earlier sworn in wins the re-run election, the time spent in office before the date the election was annulled, shall be taken into account.
This section outlines the tenure and mode of dissolution of the executive and legislative arms of an Area Council.
Subsection (1) is a new provision that increases the tenure of FCT Area Councils from 3 years to 4 years,
meaning that elections for new Chairmen and Councilors must take place every 4 years.
This four-year term includes the time spent conducting a re-run election in cases where a person who was earlier sworn
in wins the re-run. Such person will not have their term extended beyond the 4 years indicated.
Computation of time for dissolution of an Area Council is determined by the date the Chairman’s oath of office was taken or when the inauguration of the legislative arm of the Council took place, whichever is first.
