Section 37
Contested electionSubject to any other provisions of this Act, if after the latest time for the delivery of nomination papers and the withdrawal of candidates for an election under this Act more than one person remains validly nominated, a poll shall be taken.
In contrast to Section 36 where there is no validly nominated candidate for an election, this section provides that if there is more than one candidate validly nominated after the exhaustion of all INEC’s allowed time limits for nominations and amendments, there will be an election.
