Section 36
Failure of nominationWhere at the close of nomination there is no candidate validly nominated, the Commission shall extend the time for nomination and fix a new date for the election.
The section provides for cases where no candidate has been validly nominated by any of the political parties for a position after the time limits allowed by the Electoral Act has been exceeded. In this case, INEC must extend the time and change the date of the election. This is to give more time for candidates to be nominated.
