Section 98
Powers of the Commission(1) The conduct of elections into the offices of Chairman, Vice Chairman and a member of an Area Council and the recall of a member of an Area Council shall be under the direction and supervision of the Commission in accordance with the provisions of this Act.
(2) The register of voters compiled and the polling units established by the Commission and any other regulations, guidelines, rules or manuals issued or made by the Commission shall be used for elections into the Area Councils or recall of a member.
This section empowers the Commission to conduct elections to the office of the Chairman, Vice Chairman and a member of an Area Council of the Federal Capital Territory (FCT) including the recall of an Area Council member.
Each State of the Federation has its own State Independent Electoral Commission, different from INEC, which is responsible for the conduct of elections into Chairmanship and Councillorship positions at the Local Government level. Elections to the six (6) FCT Area Councils is however managed by INEC.

it is empowered by law to conduct elections within Area Councils of the FCT
and this power does not extend to the States of the Federation
